Welcome to BCS.

The terms and conditions outlined below govern the usage of services provided by the Bandung Creative Society through the websites www.istec.eventbcs.com and www.ircys.eventbcs.com. Users are urged to read it carefully as it may have an impact on their legal rights and obligations.

By registering and/or using our website the user is presumed to have read understood and agreed to all of the Terms and Conditions. These terms and conditions are specified in a legal agreement between the User and Bandung Creative Society. If the user does not agree to any section of the Terms & Conditions he or she is not entitled to utilize the Bandung Creative Society's services.

A. Definition

1. Bandung Creative Society is a limited liability corporation that organizes events mostly in the fields of education seminars and exhibitions with the goal of enhancing student accomplishment. Bandung Creative Society abbreviated as BCS.

2. BCS organizes two activities: the International Science Technology Engineering Competition (ISTEC) and the International Research Competition for Young Scientists (IRCYS).

3. BCS sites include istec.eventbcs.com and ircys.eventbcs.com.

4. Terms and conditions are an agreement between the user and BCS that includes a set of regulations that govern the user's rights obligations and responsibilities as well as processes for utilizing the BCS service system.

5. Users are individuals who use BCS services such as participants mentors or others who merely browse the BCS website.

6. Participants are registered students in both ISTEC and IRCYS activities who conduct activities on the BCS site.

7. Mentors are registered users of ISTEC and IRCYS activities who participate on the BCS Site.

8. The committee is made up of BCS members other organizations/departments/companies that collaborate with BCS and/or volunteers for BCS-approved activities.

9. The Jury Council is in charge of examining determining and deciding on the Grand Award winners during the activity. The jury's ruling cannot be disputed.

10. BCS provides a refund facility for returning transaction funds. These monies can be used to perform other transactions for BCS facilities and/or withdrawn to a registered bank account.

11. Feed is a feature on the BCS Site that displays content from BCS.

12. School Partners are schools selected by BCS as school partners with the aim of school success and achievement both directly and indirectly.

13. Products include all resources generated by BCS such as activities ideas information materials distributed or related to promotions in any way.

14. BCS Official Account is a joint account established by BCS and users to handle transactions.

B. Account, Refund, Password and Security

1. The User represents and warrants that he is at least 18 (eighteen) years old or married not under guardianship and that he has the legal capacity and authority to bind himself to these Terms and Conditions. If the User fails to comply with these provisions but continues to access or use the Site services available on the Site third-party content on the Site offers on the Site or payment methods applicable on the Site the User represents and warrants that the User's actions in opening accessing or carrying out other activities on the Site were approved by the User's parents or guardians. The User expressly waives any rights under applicable laws and regulations to cancel or revoke any and all approvals granted under these Terms and Conditions at the time the User is declared legally adult.

2. Users who have registered have the right to act as: Participants; Mentors; Partners and/or; Organizer Partners;

3. Users are required to fill in their true personal data.

4. BCS without prior notification to the User has the authority to take necessary action for any alleged violation or violation of the Terms & Conditions and/or applicable law namely actions in the form of changing data deleting data data moderation data deletion account suspension and/or deletion of user account.

5. Users understand and agree not to use modify disassemble carry out exploitative activities on software or hardware systems networks and/or Site data with automatic or manual technology without permission from BCS.

6. Users agree not to use and/or access the BCS system directly or indirectly either in whole or in part with viruses software or other technology that can weaken damage disrupt or inhibit limit and/or take over the functionality and integrity of the software or hardware systems networks and/or data on the BCS Site.

7. Users are prohibited from creating and/or using hardware/software/features and/or other tools including but not limited to emulators robots macros crawlers and/or automatic devices with the aim of accessing or using services on the BCS system such as but not limited to: Data manipulation; Create multiple accounts; Manipulate the device with the aim of harming BCS; Browsing activities (crawling/scraping) or copying content; Automation activities in transactions promotions etc.; Collect (harvest) or steal user data; Spamming sending large amounts of electronic communications sending chain letters; and/or Other activities that can reasonably be assessed as acts of manipulation of services and systems.

8. BCS has the authority to adjust data and/or carry out the moderation process/close User accounts if fraud is known or suspected by Users aimed at manipulating User data to further the User's goals. An example is carrying out an abstract assessment process using a personal account or other personal account.

9. Refunds come from returning transaction funds to BCS.

10. Refunds can be used as a payment method for transactions on the BCS Site and withdrawals can be made to the User's bank account.

11. Users understand and agree that Refunds have a value of 75% of the transaction.

12. BCS has the authority to freeze User Refunds if fraud is found/suspected in transactions and/or violations of BCS terms and conditions.

13. Users are prohibited from duplicating invoices duplicating products or other actions that could be indicated as unfair competition.

14. Users have the right to change their personal data in accordance with the policies determined by BCS. Users must ensure that changes to personal data are as desired and Users are personally responsible for changes to personal data made by Users. The User agrees that any legal engagements and actions that occurred before the change in personal data remain binding on the User.

15. Users have the right to make changes to the account name. The User must ensure that changes to the account name are as desired and are personally responsible for changes to the account name made by the User. The User agrees that any engagement that occurred prior to the name change remains binding on the User.

16. The User is personally responsible for maintaining the confidentiality of the account and password for all activities that occur under the User's account.

17. BCS will not ask for usernames or passwords belonging to User accounts for any reason therefore BCS urges Users not to provide this data or other important data to parties on behalf of BCS or other parties whose security cannot be guaranteed.

18. The User agrees to ensure that the User exits from the account at the end of each session and notifies BCS of any unauthorized use of the User's password or account.

19. The User hereby declares that BCS is not responsible for any losses or problems arising from misuse of the User's account due to the User's negligence including but not limited to approving and/or providing account login access sent by BCS via notification messages to other parties via the device Users lending accounts to other parties accessing links or hyperlinks provided by other parties giving or showing passwords or emails to other parties or other User negligence that results in losses or problems with the User's account.

20. Users are prohibited from promoting other activities organizations similar to BCS and/or other benefits from other than BCS directly to anyone with the aim of harming BCS and thereby disturbing the comfort of other Users.

C. Pricing

1. Price is the cost that needs to be paid for accommodation during the activities of the User, both Participants and Guides.

2. Discounts are discounts for participants registered with School Partners.

3. The prices listed on the BCS website are the prices set by BCS. Users are prohibited from manipulating prices in any way.

4. The User understands and agrees that errors in price information and other information caused by the BCS website pages not being updated due to the browser/ISP used by the User are the User's responsibility.

5. The User understands and agrees that typographical errors that cause price information or other information to be incorrect/inappropriate are the User's responsibility. Please remember in this case, if an accidental error in typing the price information occurs, the User has the right to notify BCS.

6. Users understand and agree that any problems and/or disputes that occur due to disagreements between BCS and Users regarding prices are not the responsibility of BCS.

7. By carrying out a transaction via BCS, the User agrees to pay the total costs that must be paid as stated in the invoice, which consists of Price, Discounts and other costs that may arise and will be described expressly in the invoice. Users agree to make payments via the payment method previously selected by the User.

8. BCS serves transactions in Rupiah and Dollars.

D. ISTEC Activities

1. ISTEC is one of the activities organized only by BCS, except but not limited to collaborating with other organizations/departments/companies.

2. ISTEC is a research competition that has an exhibition format. Exhibition here means that participants will occupy the booth provided by the Committee.

3. With an exhibition format, participants wait for the jury to go from booth to booth to assess all participants.

4. Participants acknowledge and understand that Participants must be ready until the Jury arrives at the Participant's booth because there will be a queue for judging.

5. The committee is obliged to provide the best service for participants and supervisors during ISTEC activities.

6. The committee is obliged to provide a Participants Guideline for Participants and Supervisors for ISTEC activities in the year it is held.

7. Participants and Supervisors are obliged to follow the rules of the game stated in the ISTEC Participants Guideline in the year of implementation.

8. Bearing in mind that the ISTEC Participants Guideline can change at any time without notice for the sake of smooth running of activities, Participants and Supervisors are obliged to always ensure that the ISTEC Participants Guideline they have is up to date. The ISTEC Participants Guideline is always available on the istec.eventbcs.com page.

9. Participants and Supervisors acknowledge and understand that BCS has made the best efforts possible in providing information about ISTEC activities to Participants and Supervisors, however BCS can make adjustments to the information for the smooth running of activities.

10. Participants and Mentors understand and agree that problems in the form of force majeure beyond the control of the ISTEC Committee are beyond the responsibility of BCS. For example, Participants and/or Mentors present when they are sick, it is the Participant's and Mentors' own discretion to continue or cancel participation in ISTEC activities in the year of implementation.

11. All ISTEC Grand Finalists in that year are entitled to receive certificates, medals and access to achievements such as curation.

12. The ISTEC committee in the year of implementation is obliged to include ISTEC in Kurasi Puspresnas as a form of BCS responsibility for the convenience and benefits of ISTEC participants in the year of implementation.

E. IRCYS Activities

1. IRCYS is one of the activities organized only by BCS, except but not limited to collaboration with other organizations/departments/companies.

2. IRCYS is a research competition that has a conference format. The conference here means that participants will enter the judging room containing a panel of judges to assess the participants' research.

3. With a conference format, participants wait their turn to enter the judging room.

4. Judging is carried out in a closed room. No one other than the jury, the committee on duty, and participants may enter the judging room without the permission of the committee on duty.

5. Participants understand and understand that Participants must be ready until the Committee calls for the Participant's turn because there will be a queue for assessment.

6. The committee is obliged to provide the best service for participants and supervisors during IRCYS activities.

7. The committee is obliged to provide a Participants Guideline for Participants and Supervisors for IRCYS activities in the year it is held.

8. Participants and Supervisors are obliged to follow the rules of the game stated in the IRCYS Participants Guideline in the year of implementation.

9. Bearing in mind that the IRCYS Participants Guideline can change at any time without notice for the sake of smooth running of activities, Participants and Advisors are obliged to always ensure that the IRCYS Participants Guideline they have is up to date. The IRCYS Participants Guideline is always available on the ircys.eventbcs.com page.

10. Participants and Supervisors acknowledge and understand that BCS has made the best efforts possible in providing information about IRCYS activities to Participants and Supervisors, however BCS can make adjustments to the information for the smooth running of activities.

11. Participants and Mentors understand and agree that problems in the form of force majeure beyond the control of the IRCYS Committee are beyond the responsibility of BCS. For example, Participants and/or Mentors present while sick, it is the Participant's and Mentors' own discretion to continue or cancel participation in IRCYS activities in the year of implementation.

12. All IRCYS Grand Finalists in that year are entitled to receive certificates, medals and access to achievements such as curation.

13. The IRCYS committee in the year of implementation is obliged to include IRCYS in Kurasi Puspresnas curation as a form of BCS responsibility for the convenience and benefits of IRCYS Participants in the year of implementation.

14. All IRCYS participants have the right to submit their articles to the Proceedings of the International Research Competition for Young Scientists that year.

15. If there is no Proceeding in the year where IRCYS is held, it will be included in the following year's Proceeding.

F. School Partners

1. School Partners are schools selected by BCS as school partners with the aim of school success and achievement, both directly and indirectly.

2. School Partners are ideally selected by BCS, with conditions and confidentiality that only BCS has.

3. Schools wishing to register to become School Partners are required to take part in ISTEC and/or IRCYS at least 1 (one) time in the year of implementation.

4. School Partners are entitled to the following benefits:

  • a. Special access to ISTEC and IRCYS activities;
  • b. Inclusion of school logos in ISTEC and IRCYS activities;
  • c. Symbolic plaque at the end of ISTEC and IRCYS activities;
  • d. Partner benefits such as curation priority, and so on; and/or
  • e. Discount of 20% with special conditions mentioned in ISTEC and IRCYS activities.

5. School Partners are not only limited to participants from Indonesia, all schools have the opportunity to become School Partners.

6. Schools selected to become School Partners are free of charge.

G. Organizer Partners

1. Organizer Partners are organizations both domestic and foreign that collaborate with BCS.

2. Status, symbols, logos, names or other things related to Organizer Partners or BCS are entirely the authority of BCS which is bound by the MoU between the two parties and is only given by BCS to Users with BCS permission. Users are not permitted to imitate or use these things in Names, Schools, Research Names, Research Photos, Research, etc.

3. All forms of benefits and conditions between Organizer Partners and BCS will be regulated in an MoU whose form is specific for each Organizer Partner.

4. BCS, without prior notification to Users, has the authority to take action to remove any content that violates the BCS Terms & Conditions and/or applicable laws relating to Organizer Partners.

H. BCS Confidentiality

1. BCS is a limited liability company, therefore BCS has the right to maintain data and financial confidentiality as regulated in applicable legislation. This confidentiality can be interpreted as information about the business activities of business actors.

2. Company secrets refer to Article 23 of Law 5/1999 jo. Constitutional Court Decision No. 85/PUU XIV/2016.

3. These company secrets include:

  • a. Substantive confidentiality or business confidentiality is confidentiality as regulated in Law no. 30 of 2000 concerning Trade Secrets, including production methods, processing methods, sales methods, or other information in the field of technology and/or business that has economic value and is not known to the general public. In the KIP Law, article 17 letter b is stated as information which, if disclosed, could disrupt the interests of IPR protection and protection from unfair business competition;
  • b. Confidentiality of personal data as regulated in Law no. 24 of 2013 concerning Population Administration article 58 paragraph (2)). In the KIP Law, this is regulated in article 17 letter with the term personal secrets. Apart from that, it is also regulated in Minister of Communication and Information Regulation No. 20 of 2016 concerning Protection of Personal Data in Electronic Systems;
  • c. Confidentiality of employee personal data. The legal basis and types are the same as the confidentiality of personal data;
  • d. Confidentiality as a consequence of the agreement with the client. Although in essence, this information is open, if the client wants it closed, it can be considered a company secret;
  • e. Confidentiality relating to the law enforcement process for a case affecting a company as regulated in the KIP Law Article 17 letter a);
  • f. Confidentiality of documents containing state secrets. Documents like this may be obtained or produced from a collaborative process with government agencies as regulated in the KIP Law Article 17 letters a, c, d, e, f.

4. By referring to the points above, the personal data of employees, jury members, participants, mentors, partners, users, etc. is confidential. Including but not limited to bookkeeping and financial conditions for each activity organized by BCS.

5. BCS has the authority to investigate transactions related to data theft by detaining the relevant process for a certain time until the investigation is complete. BCS also has the authority to impose restrictions related to the MoU and/or cancel the MoU unilaterally if there are indications of violations of applicable legal provisions and/or the BCS Terms and Conditions.

6. Users understand and agree that they are personally responsible for maintaining the confidentiality and/or security of User data by maintaining confidentiality when filling in personal data.

7. BCS will stop collaborating with Partners or Organizer Partners who take actions that could harm Participants, Mentors and/or other Partners.

I. Withdrawal of Refund Funds

1. Withdrawal of refund funds for Indonesian Participants will be processed within a maximum of 5x24 working hours.

2. Withdrawal of refund funds for Overseas Participants will be processed within a maximum of 5x24 working days, bank processes and so on following the provisions of the relevant bank.

3. For fund withdrawals for overseas account numbers, any additional fees charged will be the responsibility of the User.

4. In the event that there is an alleged violation of the BCS Terms and Conditions, fraud, manipulation or crime, the User understands and agrees that BCS has the right to carry out inspection, freezing, suspension and/or cancellation of funds withdrawals made by the User.

5. Examination, freezing or postponement of fund withdrawals as referred to in Point I.3 can be carried out for as long as required by BCS.

J. Cancellation of Participation

1. Cancellation of Participation is a situation where the Participant and Guide (whether in a state of urgency or not) are unwilling to take part in activities held by BCS for any reason.

2. Participation cancellation is an option for each User provided by BCS to facilitate the Participant's internal problems that occur during the process of participating in activities held by BCS.

3. Cancellation of Participation is the right of every User.

4. Users are required to notify the Committee if they wish to cancel participation and the reasons.

5. BCS is not responsible for any negligence that occurs to the User which causes harm to the User.

6. Cancellation of participation in phase 1 as explained in the Participants Guideline for each activity is not subject to any sanctions.

7. Cancellation of participation in phase 2 as explained in the Participants Guideline for each activity will be subject to sanctions in the form of recording the User's commitment and integrity in participating in activities held by BCS.

8. Cancellation of participation at the last stage as explained in the Participants Guideline for each activity will be subject to sanctions in the form of a user blacklist for activities held by BCS. The duration of the blacklist is determined by BCS as appropriate.

9. BCS has the authority to carry out mediation and/or make decisions to resolve problems in discussions related to the blacklist, even if the User has not responded to the mediation provided by BCS within the time period specified later.

10. Based on the BCS blacklist decision above, both participants and supervisors have the right to appeal, with the requirement that the party submitting the appeal must submit evidence.

11. The User hereby agrees that the BCS decision regarding the appeal is a final decision that cannot be contested and is binding on the User to comply with it.

12. Users understand that the blacklist does not apply to participants who have not participated in the activity from the start, problems related to the taste, atmosphere and/or availability of Products, and all Products as stated on the Terms and Conditions page point A.13.

13. The User understands and agrees that in completing the removal of the blacklist in mediation, the User is obliged to provide a response until completion by complying with the provisions and time limits as determined by BCS in the relevant discussion.

14. Users understand and agree that losses incurred during the blacklist resolution process are based on evidence and/or agreements provided by both parties. If the User is not willing to bear the loss, then BCS is not obliged to provide a decision on covering the loss based on the development of the relevant discussion.

15. Users understand and agree that after an agreement for mediation is reached, if they do not respond within a maximum of 1 x 24 hours, then the problem is considered resolved. BCS reserves the right not to process anything.

16. If the cancellation of participation at the last stage has reached the invoice stage, the refund will be 75% as explained on the Terms and Conditions page point B.11.

K. Other Provisions

1. If the User uses the features/services available on the BCS Site, the User hereby declares that he understands and agrees to all the terms and conditions that are specifically regulated in connection with the features/services used.

2. All things that have not been and/or are not regulated in the specific terms and conditions in this feature will fully refer to the BCS terms and conditions in general.

3. By agreeing to the BCS Terms and Conditions, Users are deemed to comply with the BCS Privacy Policy.

L. Disclaimer of Warranties and Limitation of Liability

BCS is an event organizer with Business to Customer, which provides services to users to be able to participate in BCS activities on the BCS website. Thus, the transactions that occur are transactions between BCS members and BCS, so that Users understand that BCS's proportional responsibility limits are as activity service providers.

BCS always strives to keep the BCS Services safe, secure and functioning properly, but we cannot guarantee that continuous operation or access to our Services will always be perfect. The information and data on the BCS website may not occur in real time.

The User agrees that you utilize the BCS Services at the User's own risk, and the BCS Services are provided to you on an "AS IS" and "AS AVAILABLE" basis.

To the extent permitted by applicable law, BCS (including its Parent Company, directors and employees) is not responsible, and you agree not to hold BCS responsible, for any damage or loss (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from:

  • • User's use or inability to use BCS Services;
  • • Prices or other instructions available in BCS services;
  • • Delays or interruptions in BCS Services;
  • • Negligence and losses incurred by each User;
  • • Quality of Activities;
  • • Violation of Intellectual Property Rights;
  • • Disputes between Users;
  • • Defamation of another party's good name;
  • • Any misuse of services that have been approved by the User;
  • • Losses resulting from unauthorized payments to parties other than the Official BCS Account, which in any way act in the name of BCS or negligence in writing accounts and/or other information and/or negligence on the part of the bank;
  • • Viruses or other malicious software (bots, scripts, automation tools and/or hacking tools) obtained by accessing, or connecting to BCS services;
  • • Any glitches, bugs, errors or inaccuracies in the BCS Services;
  • • Damage to your hardware from use of any BCS Services;
  • • The content, actions or inaction of third parties, including those related to products on the BCS site, are suspected to be fake;
  • • Enforcement actions taken in connection with User accounts;
  • • There are hacking actions carried out by third parties on user accounts;

M. Discharge

If you have a dispute with one or more other users, you release BCS (including its Parent Company, Directors and employees) from claims and demands for damages and losses (actual and implied) of every kind and nature, known and unknown, which arising from or in any way connected with the dispute, including but not limited to losses arising from User negligence. In this way, the User deliberately waives any legal protection (contained in laws or other legal regulations) which would limit the scope of this waiver provision.

N. Indemnification

Users will release BCS from claims for compensation and defend BCS (including the Parent Company, directors and employees) from any claims or demands, including reasonable legal costs, made by third parties arising in the event that you violate this Agreement, use of BCS Services improper conduct and/or your violation of the law or the rights of third parties.

O. Choice of Law

This Agreement will be governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflict of law rules. You agree that any legal action or dispute that may arise from, relate to, or be in any way connected with the site and/or this Agreement will be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.

However, this Agreement prioritizes discussion and kinship so that, if possible, mediation will be carried out first for all forms of violations. Including but not limited to issues of misunderstanding.

P. Renewal

Terms & conditions may be changed and/or updated from time to time without prior notice. BCS recommends that you read carefully and check this Terms & Conditions page from time to time for any changes. By continuing to access and use BCS services, users are deemed to agree to the changes in the Terms & Conditions.
